The fight against corruption is a priority task
In order to coordinate efforts to combat corruption and economic crime, the Vitebsk Transport Prosecutor's Office held 2 coordination meetings in 2016, which, among other things, addressed issues related to the fight against corruption and economic crimes.
In 2016, the Vitebsk Transport Prosecutor's Office conducted 3 (3) inspections regarding the enforcement of anti-corruption legislation, issued 3 (2) submissions, 3 (2) directives, filed 3 (0) protests, and issued 3 (0) official warnings.
As a result of the review of prosecutorial response acts, 14 (1) officials were subjected to disciplinary action, and 2 (1) to administrative liability; no material penalties were imposed on the guilty officials.
The results of the inspections indicate that instances of violations of anti-corruption legislation are widespread. The activities of the established anti-corruption commissions are, in most cases, formal in nature, and violations of local legal acts are permitted when forming the composition of these commissions.
Violations in obtaining commitments to comply with the restrictions established by Articles 17-20 of the Law of the Republic of Belarus "On Combating Corruption" are widespread.
One of the key areas in the fight against corruption is monitoring compliance with legislation during the procurement of goods (works, services). At the same time, the results of inspections indicate existing shortcomings in the conduct of competitive procedures.
The requirements for sending additional invitations to participate in competitive procurement procedures to manufacturers included in the Register of Manufacturers of Goods (Works, Services) and their Sales Organizations (Official
of trade representatives) in the amount of at least ten (if available), as well as sending such invitations to any other known potential suppliers (contractors, performers) and (or) placing the invitation in any mass media.In particular, according to clause 63 of the Regulations on the procedure for organizing and conducting procurement procedures for goods (works, services) in the construction of facilities, approved by the Resolution of the Council of Ministers of the Republic of Belarus of 31.01.2014 No. 88, when placing an order based on negotiations, the organizer determines the list of invited participants, sends them invitations to participate in negotiations, and also, if necessary, places a notice of the negotiations and (or) publishes it in any mass media. In the absence of competition in the market of goods, the tender commission (person responsible for conducting negotiations) must (must) provide the head of the negotiation organizer with a written justification establishing the reason for sending an invitation to one supplier.
The Vitebsk transport prosecutor's office will continue to take measures aimed at combating corruption and economic crime.
Thus, in accordance with the coordination plan for control (supervisory) activities in the Vitebsk region for the first half of 2017, the Vitebsk transport prosecutor's office plans to conduct inspections in February-May 2017 to enforce the requirements of anti-corruption and other legislation at Vitebsk station, Novopolotsk washing and steaming station of UP "Vitebsk branch of Belarusian Railway", OJSC "Polotsktransneft Druzhba".
In January-February 2017, it is planned to consider at a coordination meeting the issues of compliance in the Vitebsk transport region with legislation on crime prevention in 2016.
There were no problems with the application of anti-corruption legislation in the current year for the law enforcement agencies of the region.
