Thus, Mikhailov*, being the director of one of the construction enterprises in Vitebsk, abused his official powers to avoid material costs during the construction of his own country house. This abuse manifested in the gratuitous and unjustified use of motor vehicles, machinery, and special equipment of the enterprise he headed, during working hours, weekends, and holidays, for the delivery, unloading, and transportation of construction materials, as well as in the unjustified use of labor of subordinate employees for the construction of his country house.
By the verdict of the court of Zheleznodorozhny District, Mikhailov was found guilty of committing a crime under Part 2 of Article 424 of the Criminal Code of the Republic of Belarus (intentional commission by an official, contrary to the interests of service, for mercenary motives, of actions using their official powers, which caused significant harm to the rights and legitimate interests of citizens, state and public interests). He was sentenced to 2 years of imprisonment with a fine and a ban on holding positions related to the performance of organizational, managerial, and administrative-economic duties for 2 years. Part 2 of Article 77 of the Criminal Code of the Republic of Belarus was also applied to him, and the execution of the sentence of imprisonment was postponed for 2 years. The postponement of the sentence was possible only upon reimbursement of damages to the construction enterprise by the accused. Otherwise, Mikhailov would have been sent to a place of deprivation of liberty.
