Management of Common Property
The procedure for charging for housing and communal services is determined by the Regulation on the procedure for calculating and paying for housing and communal services and payment for the use of residential premises of the state housing fund, as well as reimbursement of expenses for electricity, approved by the Resolution of the Council of Ministers of the Republic of Belarus dated June 12, 2014 No. 571.
Changes have been made to this regulatory legal act. From June 1, 2021, payers of housing and communal services who are participants in joint property ownership will pay monthly for the service of managing the common property of joint property ownership.
This fee will be calculated in proportion to the total area of the residential or non-residential premises belonging to the participant in joint property ownership in the residential building.
For example: in a two-room apartment with a total area of 60 sq. m, the fee for the service of managing the common property of joint property ownership will be less than 1 ruble per month.
In order to prevent an increase in the burden on the population, after establishing the fee for managing the common property of joint property ownership, the fee for the following utility services will be reduced proportionally: technical maintenance of the building and elevator, solid waste removal, and sanitary maintenance of auxiliary premises.
Who
provides the service
for managing the common property of joint property ownership?
From the moment the ownership of apartments (non-residential premises) by two or more owners arises in a residential building, the need to manage the common property of joint property ownership arises. After all, apartment owners, in addition to the rights to residential premises, also have obligations for the operation and maintenance of their common property: entrances, roofs, basements, internal building equipment, common building meters, and other facilities.
The management of joint property ownership is an important organizational component, which is why it was decided to make it
самостоятельной услугой.Граждане могут самостоятельно управлять общим имуществом совместного домовладения, если в доме не более 10 квартир. Они также могут создать товарищество собственников или жилищно-строительный кооператив.
Если два предыдущих варианта не подходят, районный и городской исполнительные комитеты (местные администрации районов г. Витебска) назначают уполномоченное лицо по управлению общим имуществом совместного домовладения. Таким лицом может быть государственный заказчик в сфере жилищно-коммунального хозяйства.
В Витебской области осуществляют свою деятельность два государственных заказчика в сфере жилищно-коммунального хозяйства: государственное предприятие «Витебское городское жилищно-коммунальное хозяйство» и государственное предприятие «Новополоцкая управляющая компания». Информацию о данных юридических лицах можно найти в глобальной компьютерной сети Интернет на официальном сайте главного управления ЖКХ Витебского облисполкома.
В обязанности уполномоченного лица по управлению общим имуществом совместного домовладения входит: организация оказания основных и дополнительных жилищно-коммунальных услуг, проведение конкурсов по выбору исполнителей данных услуг, контроль за качеством их оказания потребителям, решение претензионных вопросов и рассмотрение обращений граждан, связанных с их желанием улучшить комфортность проживания, и многое другое.
Например: собственники квартир хотят сделать более эстетичный и дорогой ремонт подъезда, а не по минимальной смете, которую, как правило, предлагает исполнитель. Или утеплить дом. Кто должен заняться решением этих вопросов: организовать собрание, согласовать проекты, документы, найти подрядчика, принять акт выполненных работ. Этим будет заниматься уполномоченное лицо по управлению общим имуществом.
Когда будет начисляться плата за услугу по управлению общим имуществом совместного домовладения?
Жилищным кодексом Республики Беларусь определено, что уполномоченное лицо по управлению общим имуществом совместного домовладения, с момента назначения его таковым по решению районного или
city executive committees (local administrations of districts of Vitebsk), is obliged to offer the consumer to conclude an agreement on the management of common property of a joint housing complex.The standard agreement on the management of common property of a joint housing complex was approved by the Resolution of the Council of Ministers of the Republic of Belarus of January 27, 2009 No. 99 "On measures for the implementation of the Law of the Republic of Belarus "On Protection of Consumer Rights in Housing and Communal Services". The approved agreement is publicly available and contains a set of necessary essential conditions for all who receive the service of managing common property.
Authorized organizations for the management of common property of a joint housing complex are currently actively working to conclude the above-mentioned agreements with the population.
It should be noted that the consumer's refusal to conclude the agreement does not exempt him from paying for the service of managing common property. The same principle applies here as in the case of providing basic housing and communal services. Refusal is not an option.
Thus, the accrual of payment for the management of common property of a joint housing complex for residential buildings where an authorized person for the management of common property has already been appointed will be made from June 1, 2021, and for other residential buildings – from the moment of appointment of an authorized person, if one is appointed.
Information on the appointment of an authorized person for a specific residential building can be obtained from the respective district or city executive committees (local administrations of districts of Vitebsk) by territorial jurisdiction.
How will the housing management service be
provided in homeowners' associations or housing construction cooperatives?
For homeowners' associations and housing construction cooperatives (hereinafter referred to as developer organizations), nothing changes. Developer organizations have already determined their management when they decided to create a legal entity. The rights and relationships of the participants of the developer organization are fixed by the Charter, which specifies the duties of the organization
developers for the management of common property, and the powers to select utility service providers for the uniform operation of common property are delegated to the management bodies and the chairperson. The costs of managing common property are covered by membership and targeted contributions.
