Committee for Labor, Employment and Social Protection: Decree No. 6 strengthens requirements for management personnel and employees

On October 24, 2021, Decree of the President of the Republic of Belarus No. 6 of October 12, 2021, enters into force, amending Decree No. 5 of December 15, 2014 "On Strengthening Requirements for Managers and Employees of Organizations".

What will change?

1) Heads of organizations are granted the right to immediately suspend an employee from work if the employee calls on other employees to cease performing their work duties without valid reasons.
2) It is established that an employee's violation of the procedure for collecting, systematizing, storing, modifying, using, anonymizing, blocking, distributing, providing, or deleting personal data is a discrediting circumstance for dismissal.

3) A reference for an employee from their previous places of work shall be issued within seven calendar days from the date of receipt of the corresponding request.

A reference is understood as an official document reflecting the professional, business, and moral qualities of the employee, information on bringing disciplinary and other liability, attitude towards state and public institutions, and other information, prepared in the form established by the Council of Ministers of the Republic of Belarus.

4) When hiring an employee for state bodies, other state organizations, as well as organizations in which more than 50 percent of shares (stakes in the authorized fund) are state-owned, employers are obliged, unless otherwise established by legislative acts, to request:

  • a reference from their previous place of work;
  • a reference from a state organization that was their place of work during the preceding five years. If there were several such state organizations, a reference is requested from the last of them;
  • information from the unified state database of offenses regarding candidates for managerial positions. Such information is provided free of charge.

5) Violation of the procedure for hiring, appointment to a position, issuance of references containing knowingly false information, as well as violation of the deadlines for their issuance, provided for by this Decree, is considered a gross violation of labor duties.

6) Guilty acts of officials that caused damage to state property or significant harm to state or public interests, if there are grounds, entail responsibility in accordance with the Criminal Code of the Republic of Belarus.

The Decree enters into force on October 24, 2021.
