Control over the security activities of organizations for the protection of their owned facilities (property)

In accordance with Article 1 of the Law of the Republic of Belarus of November 8, 2006 No. 175-Z "On Security Activities" (hereinafter referred to as the Law), security activities are the activities of state bodies and other organizations for the protection of individuals, the protection of property of legal entities and individuals from unlawful encroachments, including illegal intrusions into them, as well as the design, installation, commissioning, and maintenance of security equipment and systems.

Control over the security activities of organizations is carried out within the framework of technical (technological, verification) measures conducted by the Security Department of the Ministry of Internal Affairs. The procedure for carrying out these measures is established by the Resolution of the Ministry of Internal Affairs of the Republic of Belarus of April 4, 2019 No. 94 "On the Procedure for Carrying Out Technical (Technological, Verification) Measures".

When carrying out technical (technological, verification) measures, the compliance by organizations, their separate divisions, and security personnel of organizations with the requirements of the Law and other normative legal acts regulating the procedure for carrying out security activities, and restrictions in the field of security activities (except for those subject to licensing control) is established.

Typical violations of legislation identified during the conduct of technical (technological, verification) measures include:

allowing security personnel to perform duties without passing a qualification exam on security activities;

security personnel are allowed to perform duties without being checked for their suitability for actions involving the use of special means and physical force;

security personnel do not undergo periodic checks for their suitability for actions involving the use of special means and physical force;

there is no documentation confirming compliance with the procedure for special training of security personnel;

security guards perform duties without official identification and badges;

security guards do not undergo medical examinations in the manner prescribed by the Ministry of Health in agreement with the Ministry of Labour and Social Protection.

The violations listed above are qualified under Article 24.37 of the Code of Administrative Offences of the Republic of Belarus as violations of the conditions and rules for carrying out security activities.

WE REMIND YOU that security guards include employees whose duties involve the direct protection of facilities and individuals.

Security guards are allowed to perform their duties only after they have undergone:

a medical examination in the manner prescribed by the Ministry of Health in agreement with the Ministry of Labour and Social Protection;

a check for suitability for actions in conditions related to the use of special means and physical force, in the manner prescribed by the Ministry of Internal Affairs;

a qualifying examination on issues of carrying out security activities in the manner prescribed by the Ministry of Internal Affairs.

For security guards, it is necessary to ensure checks for legal capacity, criminal record, charges of committing a crime, being on preventive record with internal affairs bodies due to unlawful behaviour, and the non-cancellation of permits for the storage and carrying of weapons in the manner prescribed by law by sending inquiries to the relevant authorities.

All security guards must have official identification and badges of the established sample!
