Procurement in a nutshell!
The Vitebsk Transport Prosecutor's Office exercises supervision over the enforcement of anti-corruption legislation.
It should be noted that the procurement sphere continues to prevail among offenses that create conditions for corruption. The practice of controlling (supervisory) bodies indicates that numerous and diverse violations are committed during procurement, especially when using budget funds.
For example, there are cases where tender documentation specifies a particular type of product to be procured, as well as cases of including characteristics in the description of the purchased product that are inherent to a product offered by only one supplier. This prevents participants who could offer similar products on more favorable terms from participating in the procurement procedure.
Also, the applicable procurement procedure is often incorrectly determined, and the Law is applied incorrectly.
Thus, paragraph 1 of Article 18 of the Law of the Republic of Belarus "On Public Procurement of Goods (Works, Services)" contains an exhaustive list of types of public procurement procedures (open tender, closed tender, electronic auction, price quotation procedure, single-source procurement procedure, exchange trading).
Violations of the procedure for declaring income and property are not uncommon, which serves as grounds for bringing officials obliged to submit income and property declarations to administrative responsibility.
The most common violations were: failure to submit a declaration within the period established by law; non-disclosure or incomplete disclosure of income, including insurance payments, winnings at bookmakers, money transfers; non-disclosure of owned property (real estate, vehicles); indication of false information about the value of property.
