The nuances must be taken into account
The Vitebsk Transport Prosecutor's Office has analyzed the compliance with the legislation on citizens' and legal entities' applications in one of the structural divisions of UP "Vitebsk Branch of Belarusian Railway" for 2017 and the elapsed period of 2018.
In 2017, 15 applications from citizens were registered and considered at the enterprise, and 12 in the elapsed period of 2018. No applications from legal entities were received.
Despite the small number of applications received, violations of the legislation on citizens' and legal entities' applications occur during their consideration.
In accordance with Article 14 of the Law of the Republic of Belarus "On Citizens' and Legal Entities' Applications" (hereinafter referred to as the Law), written applications are considered substantively if all issues raised in them are addressed, appropriate measures are taken to protect, ensure the realization, and restore the rights, freedoms, and/or legitimate interests of the applicants, and written responses are sent to them.
For instance, one of the applications was not properly considered (not all issues were addressed), which led to a repeated application from the applicant.
Also, in violation of Article 18 of the Law, the procedure for appealing responses containing decisions to fully or partially deny applications is not always explained.
Article 2 of the Law stipulates that the provisions of this Law apply to applications from citizens and legal entities, including those received from legal entities entrusted with the functions of mass media editorial offices, except for applications subject to consideration in accordance with the legislation on constitutional proceedings, civil, civil procedural, economic procedural, criminal procedural legislation, legislation defining the procedure for administrative proceedings, legislation on administrative procedures, applications from an employee to an employer, as well as other applications for which the legislation establishes a different procedure for their submission and consideration.
At the same time, the organization received an application from an employee of the enterprise requesting to be familiarized with the rules
internal labor regulations. This appeal has been registered in the journal of citizens' appeals and has been assigned an appropriate appeal number.Similarly registered is the collective appeal of the enterprise's employees regarding the payment of business trips.
To the head of the enterprise, a representation has been made to eliminate and prevent violations of the legislation on citizens' and legal entities' appeals, as well as the causes and conditions contributing thereto. As a result of its consideration, two employees have been disciplined.
