From 29.10.2018, the Law of the Republic of Belarus of 17.07.2018 entered into force, which, in particular, introduced amendments to the current Code of the Republic of Belarus on Administrative Offenses (KoAP) and the Procedural and Enforcement Code of the Republic of Belarus on Administrative Offenses (PIKoAP).

One of the innovations of the KoAP and PIKoAP is the introduction of a new type of administrative penalty – an administrative ban on visiting physical culture and sports facilities. This type of administrative penalty is additional and is imposed only by the court.

A ban on visiting physical culture and sports facilities may be applied for committing administrative offenses specified in Articles 9.1, 16.10, 17.1, 17.3, 17.10, 17.11, 17.14, 23.4, 23.34 of the KoAP on the territory of a physical culture and sports facility during sports and mass events or sports competitions, if administrative arrest is provided for the committed offense. The administrative ban is established for a period of three months to three years. This period is calculated from the moment the decision imposing the penalty enters into legal force.

The administrative ban on visiting physical culture and sports facilities consists in the temporary prohibition for a natural person to visit physical culture and sports facilities during sports and mass events and sports competitions.

The decision on the administrative ban on visiting physical culture and sports facilities is enforced by the internal affairs bodies and is carried out by preventing persons subjected to this administrative penalty from entering the territory of physical culture and sports facilities or by removing them from the specified territory during sports and mass events or sports competitions.

Article 24.13 of the KoAP introduces liability for violating the established ban on visiting physical culture and sports facilities. Failure to comply with this ban entails a fine of 2 to 20 basic units or administrative arrest.
