On measures to strengthen public safety and discipline
The prosecutor's offices of the region have ensured systematic supervision over the enforcement of labor and occupational safety legislation, the management and preservation of property by agricultural organizations.
During the mass field work, the effectiveness of measures taken by local executive and administrative bodies, and heads of agricultural organizations to comply with the requirements of Decrees of the President of the Republic of Belarus of 11.03.2004 No. 1 "On measures to strengthen public safety and discipline" and of 14.06.2007 No. 3 "On priority areas for strengthening the state's economic security", to ensure property safety, to prevent mismanagement, inefficient use of material and financial resources, to ensure labor discipline and safe working conditions is constantly analyzed.
For 9 months of 2020, in the region, 26 (18) workers were seriously injured in accidents at agricultural enterprises: in Braslavsky, Verkhnedvinsky, Gorodoksky, Gluboksky, Polotsky, Chashniksky, Sharkovshchinsky districts - 1 case each; in Beshenkovichsky, Ushachsky, Miorsky, Orshansky districts - 2 cases each; in Shumilinsky district - 3 cases; in Vitebsky district - 4 cases.
Most injuries occurred during the repair of agricultural machinery, or related to transport - 17, and during livestock maintenance - 6.
The analysis of the causes and conditions of accidents indicates that not all employers pay due attention to compliance with the requirements of occupational safety legislation, and the occupational safety services of enterprises work ineffectively, despite having the relevant powers. Preventive work by the management and persons responsible for occupational safety at enterprises often does not yield the proper results, and safe labor organization is not properly organized, which is one of the reasons for worker injuries.
The results of supervisory activities indicate that prosecutors continue to identify shortcomings in the activities of occupational safety commissions and mobile groups, which subsequently negatively affects the state of labor and executive discipline,
level of labor protection in organizations, and the measures taken are often formal and do not contribute to eradicating the causes and conditions that lead to injuries.For example, during an inspection of the Vitebsk District Executive Committee's performance of its functions in state administration in the field of labor protection, the prosecutor's office of the Vitebsk region found that state administration of labor protection in the region is not carried out at the proper level. The work of the labor protection commission and the commission for the implementation of the requirements of Directive of the President of the Republic of Belarus of 11.03.2004 No. 1 "On measures to strengthen public safety and discipline" is formal and does not meet the requirements. The measures planned by the district executive committee are unchanged from year to year and are of a general nature.
The prosecutor's office of the Orsha region found that the measures taken by the executive committee to ensure compliance with labor protection legislation in organizations in the region and to prevent industrial injuries are often formal in nature.
Similar violations in the activities of local executive and administrative bodies have been identified by prosecutors in Chashniksky, Lioznensky, and Tolochinsky districts.
During supervisory activities, special attention is paid to compliance with labor protection legislation during mass field work.
A significant number of violations of current legislation continue to be identified by prosecutors in the activities of agricultural producers.
For example, it was found that farms have not ensured the conduct of briefings and pre-trip medical examinations for drivers, and there is no control over the use of work clothes by employees, including during welding operations. Repair workshops are not equipped with sanitary facilities, conditions for employees to observe personal hygiene rules have not been created, and there are no washbasins, detergents, or disposable towels. «Prozemle-Agro», OJSC «Vedrenskoe-Agro» of Chashniki district, KUP «Breeding Plant «Reconstructor», OJSC «Oboltsy», OJSC «Zhuknevo» of Tolochin district, OJSC «Novye Goryany», UP «P-S Karpeki», KUSKhP «Zakharnichi» of Polotsk district, OJSC «Vostok-Chirino», SFH named after Smirnov, KU(SKh)P «Pridneprovsky» of Dubrovno district, GP «DrozdYAgro», UP «Vyaderovo», OJSC «Beshenkovichi Agroservice» of Beshenkovichi district and others).Based on the results of supervisory measures during the sowing campaign, district prosecutors filed 20 submissions, 30 farm workers were brought to disciplinary liability, and 16 individuals were brought to administrative liability.
Since the start of the harvesting campaign, 38 submissions have been filed, 39 orders have been issued, and at the request of prosecutors, 10 officials have been brought to administrative liability, and 59 individuals have been brought to disciplinary liability.
The identified violations indicate a failure to comply with elementary labor and performance discipline by the agricultural enterprise workers themselves.
For example, due to the personal indiscipline of machine operators, grain harvesters are operated without protective covers for the belt drives of headers (OJSC «Belenevo», OJSC «Belaya Lipa» and SUP «Sovkhoz im. Masherova» of Senno district, OJSC «Prozemle-Agro» of Chashniki district, KUP «Selyavschina», KUSKhP «Krasnopolye» and KUP «Dvorishche-Ros» of Rossony district, and others).
The specified employees have been brought to administrative, disciplinary, and material liability.
The heads of agricultural enterprises ignore the requirements of fire safety rules regarding the provision of combines and grain drying complexes with primary fire extinguishing means and the training of employees according to the fire-technical minimum program (Orsha, Dubrovno, Beshenkovichi, Senno, and other districts).
In total, during the 2020 harvesting campaign, there were 3 fires of grain drying units (roof damage) and 3 fires of combines (engine compartments, wheels damaged). Investigations are underway.
Based on the results of inspections on industrial injuries for 9 months of 2020
The prosecutor's offices of the region have filed 16 submissions, and at the prosecutors' request, 47 officials have been brought to administrative and disciplinary liability. The identified violations are also reflected in a comprehensive manner in other prosecutorial response acts.Similar inspections will be continued by the prosecutor's offices in the future.
