On the results of the inspection of compliance with the legislation on livestock preservation
The results of supervisory activities indicate that the heads of agricultural organizations still do not ensure proper compliance with the legislation aimed at preventing mismanagement and unproductive cattle disposal.
Despite the implementation of measures in the region to develop the dairy industry, modernize production, and introduce new technologies, the conditions for keeping cattle on dairy farms are violated everywhere, leading to mortality and unproductive disposal of cattle. Since the beginning of the current year, an increase in cattle mortality has been noted in the farms of the Vitebsk region. According to statistical data as of 01.07.2016, 5,114 heads of cattle died (+563 heads compared to last year). The highest mortality was recorded in Sennensky (+189 heads), Ushachsky (+96), Verkhnedvinsky (+93), Dokshitsky (+71), and Vitebsky (+49) districts.
For example, in GP "AgroSittsy", OAO "Torguny", OAO "Barsuchanka" of the Dokshitsky district, cases of animal mortality due to the presence of foreign objects in the feed are widespread. Thus, in OAO "Barsuchanka", a fragment of wire was found during the autopsy of a deceased animal, and in GP "AgroSittsy", a nail was found during the autopsy of a deceased cow. During the visit of the district prosecutor's office employees to the livestock farms of OAO "Torguny" and OAO "Barsuchanka" in the Dokshitsky district, fragments of polyethylene film and twine were found in the cattle feed. In connection with the revealed violations, orders were issued to the heads of the farms, and a representation was made to the head of the department of agriculture and food of the district executive committee, based on the results of which, 3 persons were brought to disciplinary responsibility, and the district prosecutor's office prepared 2 lawsuits to the court for compensation of damages caused by cattle mortality from the guilty persons.
Violations in feeding and keeping livestock were allowed in OJSC "Lyubinovo", UPKS "Miory", OJSC "Driguchi" of Miory district, CJSC "ASB Agro-Novator", OJSC "Drozd-Agro" of Beshenkovichi district, OJSC "Belenyovo" of Senno district, and other farms in the region.
At the same time, the management of enterprises did not analyze the causes and conditions of animal morbidity, and persons guilty of violating veterinary and sanitary norms and rules in the organization of feeding, keeping, and treatment of animals were not held accountable.
For example, non-compliance with the requirements of Article 27 of the Law of the Republic of Belarus "On Veterinary Activities" and other requirements of veterinary legislation by employees of OJSC "Adamenki", OJSC "Barseevo", KUSP "Krynki" of Liozno district in 2015-2016 resulted in the death of 79 heads of cattle. The material damage caused to the enterprise by the culpable actions of the employees was not compensated, and the cost of the deceased livestock was written off as losses of the farm. The prosecutor of Liozno district protested the decisions of the farm managers to attribute the damage from cattle deaths to losses, and through response acts, 2,504.8 rubles (25,048,000 rubles) were compensated, and 62.7 rubles (627,000 rubles) were recovered through court proceedings.
Despite the fact that issues of biological protection of both pig complexes and dairy complexes and farms are currently of particular relevance, the requirements for the design, equipment of premises, territories of dairy farms, and conditions for keeping cattle, established by the Veterinary and Sanitary Rules for Dairy Farms of Organizations Engaged in Milk Production, approved by the Resolution of the Ministry of Agriculture and Food of the Republic of Belarus of March 17, 2005, No. 16, and the Veterinary and Sanitary Rules for Keeping Cattle on Livestock Complexes, approved by the Resolution of the Ministry of Agriculture and Food of the Republic of Belarus of January 29, 2014, No. 1, are not being universally fulfilled.
Thus, disinfection barriers are not provided at livestock facilities, and sanitary checkpoints, fences are absent.

При этом, в ходе проведения работ в ОАО «Васюки» Шарковщинского района, СРДУП «Выдрея» РУП «Витебское отделение Белорусской железной дороги», ОАО «Новая Дубрава-Агро» Лиозненского района, ОАО «Турково», ПУПКС «Юбилейный», ПУПКС «Миорский», ОАО «Папшули», СУП «Повятье», ОАО «Мерица» Миорского района и других хозяйствах области по заготовке кормов допускаются нарушения технологии: подъездные пути не высланы соломой, масса должным образом не утрамбована, наблюдается повышенная температура травяной массы, при производстве работ отсутствуют ответственные специалисты, журналы учета закладки сенажа отсутствуют, либо ведутся ненадлежащее и другие нарушения, влекущие снижение качества кормов.
Распространённость падежа влечет за собой попытки руководителей и должностных лиц хозяйств скрыть его от учёта под видом продажи населению и работникам хозяйства (КУСХП им. Черняховского Дубровенского района, КУСХП «Кащинское» Чашникского района).
Хозяйствами не обеспечен надлежащий учёт движения скота, допускаются многочисленные нарушения при ведении первичных учетных документов, что может способствовать разного рода хищениям.
В ходе проведения мониторинга 13.07.2016 прокуратурой области совместно со специалистами КГК по Витебской области по вопросам непроизводительного выбытия КРС из хозяйств Глубокского района установлено, что в СХФ «Прошково» в декабре 2015 г. из дойного стада исключено 170 голов коров. По объяснениям руководителя и главного зоотехника хозяйства коровы были переведены на откорм по причине их низкой производительности. При этом соответствующие документы, подтверждающие данный факт, не оформлялись. В связи с выявленными нарушениями требований учетной политики прокуратурой Глубокского района организована проверка в порядке ст.174 УПК Республики Беларусь.
Установлены факты продажи крупного рогатого скота
for persons engaged in illegal entrepreneurial activity, under the guise of selling cows to the population and farm workers (OAO "Rosskiy Selets", SUP "Radunskoe", OAO "Orshanskiy Rayagroservis" of Orsha district, OAO "Priozerniy Mir" of Shumilino district, OAO "Bobrovo" of Lepel district).During the analysis of sales prices, facts of selling livestock below cost were revealed.
In particular, the prosecutor's office of Chashniki district established that in OAO "Vedrenskoe-Agro", cattle were sold to legal entities, individual entrepreneurs and individuals not related to processing enterprises at prices below the actual cost. For example, in February 2016, a cow weighing 355 kg was sold to an employee of the enterprise as part of wages at a price of 25,000 rubles per kilogram, and 16 heads of cattle with a total weight of 4,229 kg were sold to an outsider at prices of 7,486 rubles and 9,000 rubles per kilogram. In March 2016, 3 heads of cattle with a total weight of 1,101 kg were sold to another person at a price of 6,000 rubles per kilogram.
On 30.07.2016, the prosecutor of Chashniki district organized an inspection in accordance with Art. 174 of the Criminal Procedure Code of the Republic of Belarus.
The results of the inspection indicate that officials of the departments of agriculture and food of district executive committees, the committee for agriculture and food of the regional executive committee have not established proper control over the activities of agricultural enterprises regarding the disposal of livestock, the formation of reliable information about the actual number of dairy cows in the region, increasing the efficiency of livestock production, and compliance with the requirements of legislation on livestock safety.
In particular, the study of the situation regarding livestock disposal in Glubokoe, Lepel and Shumilino districts showed that district agricultural departments did not analyze the reasons and grounds for the sale of cattle by farms to commercial organizations and the population, as well as the formation of prices for livestock sales by agricultural enterprises. Culling of the main herd was carried out by farm specialists without control.
The presented facts indicate not only a violation of veterinary and sanitary and
зоотехнических норм и правил, но и требований Директивы Президента Республики Беларусь от 14.06.2007 №3 «О приоритетных направлениях укрепления экономической безопасности государства», предписывающей руководителям организаций осуществлять должный контроль за бережным и рациональным использованием материальных ресурсов.Всего по результатам проверок райпрокурорами области внесено 9 представлений, вынесено 2 предписания, принесено 15 протестов, предъявлено 20 исков на сумму 232 570 млн. рублей о взыскании ущерба, причиненного хищениями, недостачами и падежом скота. Прокуратурой Витебской области внесено представление председателю комитета по сельскому хозяйству и продовольствию Витебского облисполкома Догелю С.А. об устранении нарушений законодательства о сохранности скота.
