On the implementation of legislation on citizens' and legal entities' appeals
Compliance by supervised enterprises with the legislation on citizens' and legal entities' appeals by the Vitebsk Transport Prosecutor's Office in the current period of 2018 was studied during the exercise of supervisory activities.
For 11 months of 2018, the prosecutor's office received 63 written appeals from citizens and legal entities. Based on the results of considering the appeals, necessary and sufficient measures were taken to eliminate the identified violations of legislation and restore the violated rights of citizens.
21 appeals were sent for resolution to other organizations, as they did not fall within the competence of the prosecutor's office. When sending appeals for substantive consideration to other bodies, in order to prevent repeated appeals, their consideration was taken under control by the prosecutor in all necessary cases.
As a rule, citizens appeal with complaints about the actions and decisions of inquiry and preliminary investigation bodies, as well as on issues related to labor, administrative, and customs legislation.
Legal entities most often apply to the prosecutor's office with petitions for assistance in recovering overdue accounts receivable.
In case of rejection of appeals, reasoned, motivated responses are sent to the applicants with a reference to the relevant regulatory legal acts and an indication of why the applicants' arguments are considered unfounded, and the procedure for appeal is explained.
Reception of citizens in the prosecutor's office by operational staff is carried out according to the existing schedule of reception of citizens.
For 11 months of the current year, 81 citizens were received in person.
There were no facts of serious violations committed by officials of supervised transport enterprises in the area of executing legislation on appeals.
However, on 06/20/2018, the Orsha Civil Structures District received a written appeal from dormitory residents regarding the supply of hot water of inadequate temperature to their apartments.
In fact, the collective appeal was not considered by the district, as the arguments set out in the appeal
not been checked, as a result of which the transport prosecutor's office issued an order to the head of the distance to eliminate violations of the legislation on citizens' and legal entities' appeals. Based on the results of the consideration of the order, all arguments set out in the appeal were checked, and the applicants were given a proper response.
