Close attention to citizens' appeals

  Handling of appeals is an important component of the activities of all state bodies, including the prosecutor's offices, and is considered one of the indicators of their effectiveness. Resolving appeals on the merits, as well as studying and analyzing their dynamics, allows for the proper organization of work with citizens and legal entities, planning inspections at enterprises and organizations, and determining priority areas for interaction with the population.

In total, in 2015, the prosecutor's offices of the region received 7447 appeals from citizens, of which 4286 were resolved directly by prosecutors, with 422 being satisfied.

An analysis of the resolved applications indicates that the majority of them concerned issues of the quality of investigation and inquiry – 1,733, supervision over the enforcement of legislation – 1,129, including administrative, labor, housing legislation, and appeals from citizens and legal entities.

Problems related to the enforcement of labor legislation remain relevant. The majority of appeals recognized as justified in this area concerned delays in settlements upon dismissal, untimely payment of wages, and unjustified deductions from them.

For example, the prosecutor's office of Novopolotsk received a complaint from two citizens about violations of labor legislation in the private enterprise "K

12», which manifested in the failure to meet salary payment deadlines. Based on the results of the inspection, signs of an offense under Part 1 of Article 9.19 of the Code of Administrative Offenses of the Republic of Belarus were found in the actions of the enterprise's officials. The city prosecutor's office has sent an instruction to the Polotsk inter-district department of the Vitebsk regional labor inspection to prepare an administrative offense case. A representation has been made to the head of the enterprise to eliminate the identified violations, the causes, and the conditions contributing to them.

According to the report from the labor inspection department, the enterprise "K 12" and its director have been brought to administrative responsibility in the form of a fine amounting to 1,800,000 rubles and 720,000 rubles, respectively. In addition, the individuals responsible for the violations have been subjected to disciplinary action.

Another example.The prosecutor's office of Dokshitsy district received a collective complaint from employees of OJSC "Torguny" regarding violations of labor legislation.

During an on-site inspection, it was established that as of August 3, 2015, the specified company had not paid salaries to employees for May-June 2015, totaling 2,087.1 million rubles.

To eliminate the identified violations of labor legislation, a directive was issued to the head of OJSC "Torguny". At the request of the district prosecutor, OJSC "Torguny" and its director were brought to administrative responsibility under Part 1 of Article 9.19 of the Code of Administrative Offenses of the Republic of Belarus in the form of fines of 1,800,000 and 720,000 rubles, respectively. The Orsha Transport Prosecutor's Office conducted an inspection following a statement by a resident of Orsha and established that on 11.09.2015, a woman with her young daughter was traveling on an economy-class regional train from Orsha to Minsk, from the Orsha-Tsentralnaya station to the Lomachino stopping point. When disembarking from the carriage at the destination in the dark, she was forced to exit onto a platform that was practically non-existent, and there was no lighting at this stopping point. During the work on replacing the boarding platform by the Orsha distance of tracks and civil structures, no measures were taken to fence off the work area and to properly inform passengers to exercise extreme caution when boarding and disembarking at the Lomachino stopping point.

Following the inspection, the Orsha Transport Prosecutor submitted a representation to the Head of the UP "Minsk Branch of Belarusian Railway" on eliminating violations of the legislation on traffic safety and operation of railway transport, as well as the causes and conditions contributing to these violations. Based on the results of its consideration, the Deputy Head of the Orsha Distance of Civil Structures and the master of the distance were subjected to disciplinary action in the form of a reprimand and a warning, and the size of bonus payments was reduced for the leading engineer of the passenger transportation organization department of the Minsk branch and the assistant head of the branch.

In general, in 2015, based on the results of considering appeals

447 acts of prosecutorial supervision were prepared for citizens, 16 criminal cases were initiated, 38 disciplinary and administrative proceedings were initiated.

In addition, 6566 people were received by prosecutors during personal appointments, including 991 at their place of residence and work, 159 arrested individuals, and 308 individuals serving sentences.

In each case, citizens were provided with practical assistance and legal support, and pressing issues were studied.

For example, during a reception at Correctional Institution-13, V.I. Pashkovsky, Head of the Department of the Regional Prosecutor's Office, received an appeal from convicted person M. regarding his disagreement with the court's non-application of the Law of the Republic of Belarus of June 17, 2014 "On Amnesty in connection with the 70th anniversary of the liberation of Belarus from the Nazi invaders" (hereinafter referred to as the Amnesty Law). During the inspection of the appeal, significant circumstances were clarified and grounds were established for filing a supervisory protest against the court decisions in the criminal case. By the decision of the presidium of the Vitebsk Regional Court, the sentence of the Postavy District Court and the ruling of the cassation instance regarding M. were amended, the provisions of Article 7 of the Amnesty Law were applied to him, and he was partially released from punishment for a term of one year.
