Conscription – effective prosecutorial supervision

The Constitution of the Republic of Belarus stipulates that the defense of the Republic of Belarus is the duty and sacred obligation of a citizen of the Republic of Belarus.

Currently, in accordance with Decree of the President of the Republic of Belarus No. 51 of 11.02.2016 "On the dismissal of conscripts and reservists and the conscription of citizens for military service, service in reserve in February-May 2016", conscription campaigns are being conducted by conscription commissions and military commissariats.

Issues of conscription have always been under the scrutiny of the prosecutor's office. We see our task as ensuring full and comprehensive supervision of this area of activity.

During the spring-summer conscription campaign, Vitebsk region will supply about 1400 conscripts to military units, and more than 100 citizens of conscription age for service in reserve.

They will serve in the Armed Forces, in the border service agencies, and in the internal troops of the Ministry of Internal Affairs.

Practice shows that the vast majority of citizens responsibly approach the conscription process, appearing on time for medical examinations and for dispatch to military units for their service.

Unfortunately, the issue of persons evading conscription has not yet been resolved, and there are about 140 such individuals today. These individuals, as a rule, persistently and by all possible means, under various pretexts, evade appearing at military commissariats in order to avoid military service, thereby fulfilling their constitutional duty.

Сложившаяся практика красноречиво говорит о том, что ст. 435 Уголовного кодекса Республики Беларусь (уклонение от мероприятий призыва на воинскую службу) не является мертворожденной. Судами области рассматриваются уголовные дела в отношении в отношении уклонистов, так их назовем, и виновные лица привлекаются к установленной уголовным законом ответственности. Прокуроры на такие процессах выступают в качестве государственных обвинителей.

Но, главная цель прокурорского надзора это не покарание за нарушение закона, а профилактика правонарушений. В этих целях прокуратурой области ежегодно планируются и проводятся прокурорские проверки исполнения должностными лицами, ответственными за проведение мероприятий призыва на военную службу, законодательства его регламентирующего. По результатам таких проверок при наличии оснований применяются меры прокурорского надзора.

В целом, общая задача отобрать и поставить в воинские формирования молодых людей для прохождения ими военной службы решается успешно всеми государственными структурами, в этом участвующими.
