The regional prosecutor's office protects the rights of an elderly woman

Regarding citizen B.'s appeal concerning the violation of her housing rights as a result of gifting her apartment to citizen G., it was established that B., born in 1937, lived alone in a well-appointed apartment. Due to breaking her leg in October 2015 and being unable to move or care for herself, she required outside assistance. Under these circumstances, she formalized a gift agreement for the apartment to G., a barely known acquaintance, with the condition that G. would provide her with care. However, subsequently, after B. suffered a stroke, G. did not take her from the hospital but placed her in a nursing care unit, from where she was taken by relatives.

In light of the foregoing, in the interests of the elderly woman, the prosecutor of the Vitebsk region filed a statement of claim with the court of Polotsk district and the city of Polotsk to declare the apartment gift agreement invalid on the grounds of Part 1, Clause 1, Article 179 of the Civil Code, due to its conclusion under the influence of delusion.

By court decision, the claim was satisfied, and the transaction was declared invalid.

The decision has entered into legal force.
