The Vitebsk Regional Prosecutor's Office has organized systematic supervision over the enforcement of legislation in the economic sphere
In the specified area, prosecutors conducted 324 (354) inspections, resulting in the issuance of 1125 (1114) supervisory acts, 2077 (2178) individuals were brought to various types of liability, and the amount of damages recovered at the request of prosecutors exceeded 2.6 (4.1) million rubles.
During the inspections, the prosecutor's offices of the region studied issues related to the reduction of overdue foreign accounts receivable and the repatriation of foreign currency earnings.
For example, the prosecutor's office of Vitebsk city identified violations in the contractual and claim-legal work of RUP "Vitebsk DSK". The enterprise did not control the execution of contracts by ZAO "SU-197" (Russian Federation) regarding the provision of documents confirming VAT payment, which resulted in losses for the enterprise in the amount of 278 thousand rubles. Based on the identified violations, the city prosecutor issued a representation to the General Director of RUP "Vitebsk DSK", as a result of which 1 person was disciplined. In addition, the city prosecutor filed 10 lawsuits in the economic court in the interests of the enterprise to recover debt from ZAO "SU-197" in the amount of 278.4 thousand rubles, of which 7 lawsuits totaling 254.4 thousand rubles were granted, and 3 applications totaling 24 thousand rubles are under consideration.
Similar legislative violations were also identified by the prosecutors of Novopolotsk city, and Vitebsk and Verkhnedvinsk districts.
The prosecutor's offices of the region paid significant attention to supervising compliance with investment legislation.
Thus, the prosecutor's office of the region identified violations
legislation during the implementation of the investment agreement concluded between the regional executive committee and SOOO "BelTitan" on the organization of an innovative import-substituting production of polymer packaging and food containers in Novopolotsk. Contrary to the requirements of Decree of the President of the Republic of Belarus No. 10 of 06.08.2009 "On Creating Additional Conditions for Investment in the Republic of Belarus", the said agreement was concluded with a violation of the deadline and did not contain mandatory conditions, and proper control over its implementation by the regional executive committee was not carried out. The investor did not commission the facility within the established period; instead of the 200 jobs provided for by the agreement, only 10 jobs were occupied in the production. Following the results of the inspection by the regional prosecutor's office, a submission was made to the chairman of the regional executive committee, and the guilty parties were brought to disciplinary responsibility, including the deputy chairman of the regional executive committee overseeing these issues.
Similar legislative violations were identified by the regional prosecutor's office based on the results of the study of the investment project "Modernization of the production complex for the production of food products based on fruits and berries". Following the inspection, appropriate submissions were made to the Vitebsk Regional Executive Committee and the director of OOO "Fabrika Fruktivykh Vkusov" (investor). Regarding the revealed violations, the Department of Internal Affairs of the Vitebsk Regional Executive Committee was instructed to conduct an inspection under Article 174 of the Criminal Procedure Code of the Republic of Belarus.
The subject of the prosecutor's inspections also included issues of fulfilling the measures of state programs, and the targeted and effective use of budget funds allocated for their implementation.
Thus, the prosecutor's offices of the region conducted inspections of compliance with legislation in the system of RUP "Vitebskavtodor", and together with the State Control Committee of the Vitebsk region, analyzed the issues of the enterprise's fulfillment of the State Program for the Development and Maintenance of Roads in the Republic of Belarus for 2015-2019, approved by Resolution of the Council of Ministers of the Republic of Belarus No. 1296 of 31.12.2014.
