The Vitebsk Regional Prosecutor's Office has analyzed the practice of prosecutorial supervision over the enforcement of legislation in the agro-industrial complex of the northern region

In the past year, prosecutor's offices conducted 75 (111) inspections in agricultural organizations concerning the management and protection of property, which is 57.3% of the total number of inspections on these issues. 115 (160) submissions were made, 210 (162) orders were issued, 9 (40) protests were filed, 511 (570) individuals were brought to disciplinary liability, 88 (47) individuals to administrative liability, and 593 (615) to material liability totaling 40,440 (44,728) rubles.

Inspections were conducted most actively and effectively by prosecutors in the Gluboksky, Verkhnedvinsky, Lioznensky, Senno, Tolochinsky, and Ushachsky districts.

In 2017, constant control was maintained over issues related to mass field work (sowing, harvesting, fodder procurement), the preservation of crops, livestock, and machinery, including during the winter period, the rational use of material resources and funds, and state support.

Facts of shortages of machinery and equipment, discrepancies between accounting data and the actual availability of agricultural machinery units, dismantling, write-offs of vehicles, and concealment of damage to machinery resulting from road traffic accidents and fires were identified in the Chashniksky, Braslavsky, Verkhnedvinsky, Lepelsky, Orshansky, Tolochinsky, Postavsky, Rossony, Senno, and other districts.

In the Vitebsk, Gluboksky, Gorodok, Braslavsky, Verkhnedvinsky, Lepelsky, Polotsk, Rossony, and Chashniksky districts, the organization of state technical inspections in agricultural organizations did not comply with the requirements of the Rules for conducting state technical inspections of wheeled tractors, trailers for them, self-propelled machines, and their admission to participate in road traffic.

In connection with the identified violations of legislation in the activities of state technical inspection bodies, the regional prosecutor's office submitted a relevant submission to the head of the Vitebsk Regional State Technical Inspection, and at the request of the prosecutor's offices, 17 district state technical inspectors were brought to disciplinary liability.

The prosecutor's offices of the region also took organizational and practical measures regarding

ensuring compliance with legal requirements during the harvest campaign.  In total, based on the results of inspections, 30 submissions were made and 132 orders were issued. At the request of prosecutors, 103 individuals were brought to disciplinary liability, and 85 individuals were brought to administrative liability.

In farms, prosecutors universally identified instances of non-compliance with the instructions of the Head of State regarding the timely preparation of grain harvesting and other equipment for harvesting operations. Based on the results of raid activities, 91 orders were issued, and 19 officials were brought to administrative liability for non-compliance with the requirements of prosecutorial supervision acts.

In addition, the prosecutor's office of the region conducted inspections of the proper fulfillment of the requirements of the Law of the Republic of Belarus "On Identification, Registration, Traceability of Farm Animals (Herds), Identification and Traceability of Products of Animal Origin" (hereinafter referred to as the Law). As a result, 15 submissions were made to executive bodies, 55 orders were issued to farm managers, and 66 responsible officials were brought to disciplinary liability at the request of prosecutors.

In particular, violations of the deadlines for implementing the identification system established by local authorities were identified, untimely tagging was allowed when inventory was available, untimely information entry into the IS ATIS, and improper completion of information in electronic passports of newborn animals due to the unscrupulous attitude towards the performance of official duties by farm workers and the lack of proper control by the management of agricultural enterprises.

There were also violations of the procedure for organizing procurement using own funds, which were expressed in the failure of individual agricultural organizations to post procurement regulations for goods (works, services) using own funds in open access on the official website of the IS "Tenders".

The supervisory authority's work in this area will continue.
