Prosecutorial supervision in the field of labor law compliance

Supervision over compliance with labor legislation regarding the timely payment of wages to employees by employers is one of the main areas of activity of the Vitebsk Regional Prosecutor's Office.

The main reasons for overdue wage arrears continue to be the lack of own funds of organizations, high debt load, low profitability and loss-making of organizations, and reduction of budget financing.

According to statistical data as of 01.09.2016, 114 organizations in the region allowed wage arrears totaling 3,948.9 thousand rubles, including 3,831.3 thousand rubles for August 2016 and 117.6 thousand rubles for previous months.

Overall, the measures of prosecutorial response taken have contributed to a decrease in the number of cases of untimely wage payments. Thus, as of 01.01.2016, 122 organizations had wage arrears totaling 44,215.8 million non-denominated rubles; as of 01.04.2016, 188 organizations allowed arrears totaling 93,794.1 million non-denominated rubles; as of 01.07.2016, 123 organizations had wage arrears totaling 43,557.5 million non-denominated rubles.

In total, over 9 months of the current year, prosecutors of cities and districts, and Vitebsk and Orsha transport prosecutors, have submitted 51 representations, issued 124 orders, and announced 34 official warnings. As a result of the review of prosecutorial supervision acts, 84 persons were brought to disciplinary responsibility.

In addition, by the resolutions of city and district prosecutors on administrative offenses, 250 officials who delayed wage payments to employees were brought to administrative responsibility. During the execution of the orders, wage arrears were paid in the amount of 764,147.96 rubles.

A priority area of activity for the Vitebsk Regional Prosecutor's Office is working with appeals from citizens and legal entities, during the consideration of which prosecutors often identify labor law violations.

Согласно статистическим данным за 9 месяцев 2016 г. незначительно увеличилось количество разрешенных обращений граждан о нарушениях трудового законодательства, в том числе и по вопросам несвоевременной выплаты заработной платы (147 обращений (в 2015 году – 133), из которых удовлетворено полностью 40 (43) обращения).

По фактам нарушений законодательства о труде, выявленных в ходе рассмотрения обращений граждан, прокурорами принимаются соответствующие меры реагирования в целях устранения допущенных нарушений, причин и условий, им способствовавших.

Прокурорский надзор в указанной сфере носит системный характер и находится на постоянном контроле прокуратуры Витебской области. В надзорной деятельности неизменным остается требование к точному и единообразному исполнению законодательства о труде, соблюдению конституционных прав работников.
