Request and theft

Sometimes you ask a person to do a good deed, and they respond with evil.

Nikolai, born in 1981, was drinking alcohol with his cohabitant at the home of their acquaintance, Alla. During the feast, Alla asked Nikolai to transfer the SIM card from her old phone to a new mobile phone. However, the SIM card could not be transferred because it did not fit the new phone in size. After that, Alla left the box with the phone on the table in the room and went to the kitchen herself. While leaving his acquaintance's house, Nikolai conceived the intent to steal the mobile phone, and he imperceptibly took the phone from the box on the table and put it in his pocket. Upon arriving home, he took out the phone and, while opening the phone cover, accidentally dropped the battery into the water, after which it became unusable. He hid the mobile phone and told no one about the theft. He denied his involvement in the theft, and when Alla reported it to the police, he got scared and returned the phone to the victim without the battery. During the investigation, he acquired a new battery similar to the damaged one. He admitted guilt and repented of his actions.

By the verdict of the court of the Zheleznodorozhny District of Vitebsk, Nikolai was sentenced in accordance with Part 1 of Article 205 of the Criminal Code of the Republic of Belarus to 100 hours of community service.
