The role of the collegium in organizing the supervisory activities of the prosecutor's office
The organization of supervisory activities in the prosecutor's offices is characterized by a combination of the principle of one-man management with collegiality in decision-making on the most pressing issues of prosecutorial work.
Article 21 of the Law of the Republic of Belarus "On the Prosecutor's Office of the Republic of Belarus" legally enshrines and regulates the activities of the collegium of the prosecutor's office.
Based on the provisions of this article, the collegium is an advisory body to the relevant prosecutor and considers the most important issues of the prosecutor's office's activities that require collective discussion and decision-making, discusses draft key orders and instructions, reports and communications from heads of structural divisions, subordinate prosecutors, and other prosecutorial staff. At collegium meetings, communications and explanations from heads of state administration and control bodies, enterprises, institutions, and organizations, as well as other officials, on issues of law enforcement may be heard.
Collegiums are established in the General Prosecutor's Office of the Republic of Belarus and in the prosecutor's offices of the regions.
In the regional prosecutor's office, the collegium is formed as part of the regional prosecutor (chairman), his deputies, and other prosecutorial staff. The personal composition of the collegiums is approved by the Prosecutor General of the Republic of Belarus upon the submission of the regional prosecutors.
An analysis of the work practice of the collegium of the Vitebsk region prosecutor's office indicates that the issues considered at its meetings are of the most pressing nature for the region, and the decisions made have a positive impact on the organization and results of law enforcement activities.
Thus, recently, the focus has been on issues of crime prevention, combating crime and corruption, organizing supervision over the enforcement of legislation by the Investigative Committee of the Republic of Belarus for the Vitebsk region, and others. The results of supervisory activities for the half-year and year were regularly summarized, the results of comprehensive inspections of the work organization of city and district prosecutor's offices were considered, and reports by prosecutors on the results of supervisory activities were heard.

ежегодно анализируется состояние служебной и трудовой дисциплины в органах прокуратуры и выполнение Директивы Президента Республики Беларусь от 11.03.2004 №1 «О мерах по укреплению общественной безопасности и дисциплины», что позволяет оперативно решать имеющиеся проблемы и принимать необходимые меры по повышению персональной ответственности подчиненных за положение дел на курируемых участках работы.Всего в минувшем году в прокуратуре области организовано и проведено 10 заседаний коллегии, на которых рассмотрено 34 вопроса. В подготовке вопросов для рассмотрения на коллегии прокуратуры были задействованы все структурные подразделения областного аппарата.
План работы коллегии на полугодие формируется и утверждается руководством прокуратуры заранее, с учетом складывающейся в области оперативной обстановки и имеющихся проблемных вопросов в работе. Если какие-то возникающие негативные тенденции требуют оперативного реагирования, необходимые меры по их преодолению определяются на внеочередном заседании коллегии.
Эффективным средством повышения ответственности прокурорских кадров являются отчеты прокуроров и руководителей структурных подразделений на заседаниях коллегии прокуратуры области о проделанной работе. В истекшем году заслушаны отчеты 11 горрайпрокуроров и 8 руководителей структурных подразделений прокуратуры области.
В последнее время при проведении заседаний коллегии активно используются современные технические средства – видеоконференцсвязь, демонстрация аналитических таблиц, фотослайдов.
Как правило, все решения коллегии по актуальным вопросам правоприменительной практики доводятся до сведения заинтересованных лиц, освещаются в средствах массовой информации.
Конечно же, ключевым аспектом работы коллегии является эффективность принимаемых решений, реальное их влияние на результаты надзорной деятельности.
Так, в марте прошлого года на коллегии рассмотрены результаты обобщения следственно-судебной практики и практики прокурорского надзора по уголовным делам и материалам о хищении огнестрельного оружия,
The state of official and labor discipline in the prosecutor's offices and the implementation of Directive No. 1 of the President of the Republic of Belarus of March 11, 2004 "On measures to strengthen public safety and discipline" are analyzed annually, which allows for prompt resolution of existing problems and the adoption of necessary measures to increase the personal responsibility of subordinates for the state of affairs in the supervised areas of work.
In total, last year, 10 collegium meetings were organized and held in the regional prosecutor's office, at which 34 issues were considered. All structural divisions of the regional apparatus were involved in the preparation of issues for consideration at the collegium of the prosecutor's office.
The work plan of the collegium for the half-year is formed and approved by the management of the prosecutor's office in advance, taking into account the operational situation developing in the region and existing problematic issues in the work. If any emerging negative trends require prompt response, the necessary measures to overcome them are determined at an extraordinary meeting of the collegium.
An effective means of increasing the responsibility of prosecutorial staff are the reports of prosecutors and heads of structural divisions at the meetings of the collegium of the regional prosecutor's office on the work done. Last year, reports of 11 city/district prosecutors and 8 heads of structural divisions of the regional prosecutor's office were heard.
Recently, modern technical means have been actively used in holding collegium meetings – video conferencing, demonstration of analytical tables, and photoslides.
As a rule, all decisions of the collegium on topical issues of law enforcement practice are brought to the attention of interested parties and are covered in the media.
Of course, the key aspect of the collegium's work is the effectiveness of the decisions made, their real impact on the results of supervisory activities.
Thus, in March of last year, the collegium considered the results of the generalization of investigative and judicial practice and prosecutorial supervision practice on criminal cases and materials on the theft of firearms,
ammunition and explosives, illegal actions regarding firearms.The collegium's decision indicated existing shortcomings and omissions in the work, and developed specific measures to improve the quality of law enforcement agencies' work in this area.
In December 2019, the collegium analyzed the reasons for courts issuing acquittals in 2019.
The collegium noted that ensuring supervision over compliance with legislation when bringing citizens to criminal responsibility remains relevant. In the work of preliminary investigation bodies, there are still cases of poor-quality investigation of criminal cases, and in some cases, prosecutorial supervision is weakened. Using examples of specific criminal cases, violations of legality and shortcomings were pointed out.
The decision adopted by the collegium will help prosecutors to more effectively supervise the initiation and investigation of criminal cases and to support the state prosecution in court.
In the future, the work of the collegium of the Vitebsk Regional Prosecutor's Office will be aimed at developing effective solutions to the most pressing issues of supervisory activities.
