From March 1, 2021, the Code of the Republic of Belarus on Administrative Offenses dated January 6, 2021, comes into force.

As of March 1, 2021, the Code of the Republic of Belarus on Administrative Offenses dated January 6, 2021 (hereinafter referred to as the Code) comes into force.

The new Code retains the provision establishing administrative responsibility for violating the procedure for organizing or holding mass events – Article 24.23 of the Code.

The actions for which responsibility is incurred under the aforementioned article are analogous to those specified in Article 23.34 of the currently effective Code. However, the responsibility for their commission has been increased in the new Code: the fine amount has been increased, administrative penalties in the form of community service are provided for, and the term of administrative arrest for repeated violation of the procedure for organizing or holding mass events has been extended.

Thus, violation of the procedure for organizing or holding mass events by its participant (Part 1 of Article 24.23 of the Code) shall entail a fine of up to 100 base units, or community service, or administrative arrest for up to 15 days. Repeated commission of the specified actions within a year (Part 3 of Article 24.23 of the Code) shall entail a fine of 20 to 200 base units, or community service, or administrative arrest for 15 to 30 days.

For violation of the established procedure for organizing or holding mass events by the organizer of such events (Part 2 of Article 24.23 of the Code), citizens face administrative responsibility in the form of a fine of 20 to 150 base units, or community service, or administrative arrest for up to 15 days. In case of repeated commission of the specified actions, responsibility is incurred under Part 4 of Article 24.23 of the Code, and the person may be subject to a fine of 20 to 200 base units, or community service, or administrative arrest for a term of 15 to 30 days.

Also, in the new Code, the responsibility for disobeying a lawful order or demand of an official while performing his official duties by a person not subordinate to him in service has been increased. Responsibility under this article is incurred under Article 24.3 of the Code and entails a fine of 2 to 100 base units, or community service.

Insulting a public official of a state body (organization) while performing his official duties by a person not subordinate to him in service entails administrative responsibility under Part 1 of Article 24.4 of the Code of Administrative Offenses in the form of a fine ranging from 20 to 30 basic units. In case of such an insult in a public speech, or in a printed or publicly displayed work, or in the media, or in information disseminated via the global computer network Internet, other public telecommunication network, or a dedicated telecommunication network, the actions of the person shall be qualified under Part 2 of Article 24.4 of the Code of Administrative Offenses and entail responsibility for an individual in the form of a fine ranging from 10 to 200 basic units, or community service, or administrative arrest for up to 15 days, and for a legal entity – in the form of a fine ranging from 30 to 200 basic units.
