Improvement of legislation on enforcement proceedings

The development of public relations and digitalization require keeping pace with the times, both for legislators and law enforcers.

As part of the study of the practice of applying legislation on enforcement proceedings and work on the draft Law of the Republic of Belarus "On Amendments to Laws on Enforcement Proceedings", on July 19, 2019, an on-site meeting of the Standing Commission of the House of Representatives of the National Assembly of the Republic of Belarus was held in Polotsk on the topic "Enforcement Proceedings at the Present Stage. Problematic Issues and Ways to Resolve Them".

The Chairperson of the said commission, Guyvik Natalya Vasilievna, the Deputy Minister of Justice of the Republic of Belarus Avdeev Andrey Dmitrievich, representatives of the deputy corps, prosecutor's offices, enforcement bodies, courts, financial and tax authorities, who took part in the meeting, noted the importance and relevance of the agenda.

During the meeting, participants' presentations on the effectiveness of legal regulation of relations related to enforcement proceedings were heard, existing problematic issues and ways to resolve them were analyzed, innovations proposed by the draft law, and other proposals for amending the legislation on enforcement proceedings were discussed.

Pashkovsky Vasily Ivanovich, Head of the Department of the Vitebsk Regional Prosecutor's Office for Supervision of Compliance with Legislation by Criminal Enforcement System Bodies and Enforcement Bodies, who took part in the meeting and spoke on the discussed topic, taking into account the provisions of the current legislation and the practice of the supervisory authority, focused on ensuring the principle of legality, the implementation of the tasks of enforcement proceedings, noted the importance of proper interaction of all structures involved in enforcement proceedings, and the need to improve the effectiveness of this work aimed at restoring the violated rights and legitimate interests of citizens and legal entities, observing and protecting the interests of the state through the correct, complete and timely execution of enforcement documents.

Following the meeting, taking into account the existing difficulties in on-site work, additional avenues and mechanisms for further analysis and elaboration of problematic issues, and directions for improving legislation and law enforcement practice have been identified.
