Improve interaction

Recently, an interdepartmental meeting was held via radio conference, chaired by the First Deputy Prosecutor of the region, A.V. Sidorovich. The meeting addressed the state of legality in the activities of criminal prosecution bodies during pre-investigation checks and the initiation of criminal cases.

The meeting noted that a set of organizational and practical measures has been implemented in the region over the past few years aimed at coordinating interaction between inquiry bodies and preliminary investigation bodies at the pre-trial production stage.

The current toolkit for interaction between the prosecutor's office and other criminal prosecution bodies in considering applications (reports) of crimes and initiating criminal cases allows for the effective implementation of the tasks assigned to these bodies to ensure legality.

However, despite the existing positive trend of a decrease in the quantity and proportion of check materials returned to inquiry bodies in accordance with clause 6, part 2, article 35 of the Criminal Procedure Code, violations of legislation in resolving crime reports and transferring materials to investigative units still remain widespread.

The main reasons for the return of materials are the evident incompleteness of checks conducted by inquiry bodies and the lack of sufficient data indicating signs of a crime.

Furthermore, employees of internal affairs bodies commit violations of the norms of criminal procedure legislation, which in some cases leads to partial acquittal of the accused, the need for additional investigative and operational measures in criminal cases and check materials, as well as the recognition of certain evidence as inadmissible and, consequently, the termination of criminal proceedings on rehabilitating grounds.

In some cases,

facts of investigators not leaving crime scenes upon applications (reports) for crimes when necessary.

Expert units are not always notified about the transfer of pre-investigation check materials from one law enforcement agency to another.

Based on the discussion results, a decision was made aimed at improving the quality of pre-investigation checks conducted by the inquiry bodies of the region. Attention was focused on improving the interaction between preliminary investigation bodies, inquiry bodies, and the State Forensic Examination Committee units.
