Installation of antennas, air conditioners according to the law

Everyone will agree with me that sometimes you want to walk around the city, admire the beauty of its streets, buildings, and structures, especially those that have stood the test of time and have preserved their historical beauty to this day.

However, city residents do not always ensure the preservation of these very buildings. Quite often, advertisements are placed on houses located on central streets, as well as those of historical value, which are objects of historical and cultural heritage. Homeowners install individual antennas and various structures that spoil the appearance of the house, and sometimes the entire street. In addition, such "improvements" can contribute to the destruction of the buildings on which they are installed.

The procedure for installing individual antennas and other structures on the roofs and facades of apartment buildings is determined by the Resolution of the Council of Ministers of the Republic of Belarus of May 16, 2013 No. 384, which approved the relevant Regulation.

The aforementioned Regulation provides that the installation of individual antennas and other structures on the roofs and facades of apartment buildings is carried out after obtaining approval from the territorial department of architecture and urban planning. Approval is not required for the installation of structures for drying laundry, which can only be installed within the internal space of a balcony and/or loggia.

To obtain approval for the installation of individual antennas and other structures, you must contact the territorial department of architecture and urban planning with a corresponding application, attaching a technical passport and a document confirming the ownership of the premises. Please note that state bodies do not charge a fee for carrying out this administrative procedure.

Based on the documents submitted by the citizen, the territorial department of architecture and urban planning, no later than 15 days from the date of application, approves the installation of individual antennas and other structures or refuses to approve and informs the initiator. In case of refusal,

the approval of the installation of individual antennas and other structures may be appealed to a higher authority or to the court.

After obtaining approval, a citizen may enter into a contract with a legal entity or individual entrepreneur engaged in the installation of individual antennas and other structures.

From the moment of installation, the citizen is assigned certain responsibilities, namely:

- to maintain the installed individual antennas and other structures in a technically sound condition and to carry out repair work in a timely manner. Defective individual antennas and other structures are subject to dismantling;

- if, during operation, violations of the requirements of technical regulatory legal acts are detected during the installation of individual antennas and other structures, to take measures to eliminate the identified violations or dismantle these antennas and structures.

It should be borne in mind that when the organization carrying out the operation of the housing stock performs roof or facade repair work on an apartment building, the citizen (if necessary) is obliged to ensure the dismantling of individual antennas and other structures for the duration of the repair work.

Please note that citizens, legal entities, and individual entrepreneurs who have carried out unauthorized installation of individual antennas and other structures are obliged to obtain appropriate approval.

Unauthorized installation on the roofs and facades of apartment buildings of individual antennas and other structures is prohibited.

It should be noted that, pursuant to Article 22.9 of the Code of the Republic of Belarus on Administrative Offenses, unauthorized alteration, repainting, or other modification of balconies, loggias, and other architectural and structural elements of the facades of residential buildings, other buildings, and structures, installation of satellite and other antennas on facades, balconies, loggias, and roofs, as well as failure to take measures to maintain the proper appearance of residential buildings, other buildings, structures, and fences, entail a fine ranging from two to fifteen basic units (from 58 to 870 rubles).
