In 2015, the region's prosecutor's offices filed 594 lawsuits in economic courts

The prosecutor's offices of the region widely use the right granted by Art. 6 of the CPC of the Republic of Belarus (hereinafter referred to as the CPC) to file lawsuits in order to protect state and public interests, and the interests of legal entities. The activity of prosecutors in applying to economic courts is one of the highest in the republic - 594 (only Gomel region is higher - 621).

In 2015, prosecutors filed 594 lawsuits (applications) with economic courts, which is 26.4% more than in 2014 (470). The amount of claims in lawsuits (applications) also increased significantly and amounted to 224,986,422 thousand rubles, 131,657 US dollars, 161,000 euros, 22,183,678 Russian Federation rubles (in 2014 - 154,506,332 thousand rubles, 26,744 US dollars, 1,516,379 euros, 135,366,965 Russian Federation rubles).

A significant number of lawsuits (applications) were filed to protect the interests of state economic entities - 44 (52) lawsuits and 192 (159) applications in summary proceedings. Lawsuits filed in the interests of the state account for 6 (14).

The prosecutors of Orsha district - 147 applications for an amount of 117.4 billion rubles, the city of Vitebsk - 56 applications for 5.3 billion rubles, were most actively representing the interests of economic entities by applying for judicial protection.

Chashniki District – 41 applications for 11.1 billion rubles, Gorodok District – 34 applications for 3.6 billion rubles, Polotsk District – 27 applications for 7.2 billion rubles, Shumilino District – 27 applications for 3.4 billion rubles, Glubokoye District – 22 applications for 17.2 billion rubles, Verkhnedvinsk District – 21 applications for 4.0 billion rubles, city Novopolotsk – 19 applications for 17.9 billion rubles, Vitebsk District – 19 applications for 4.1 billion rubles.

Compared to 2014, in many regions (with the exception of Gorodok, Liozno, Miory, Rossony, Sharkovshchina districts), claim work has been intensified. Thus, the number of claims and applications by prosecutors has significantly increased in Orsha (from 75 to 147, +96.0%), Verkhnedvinsk (from 12 to 21, +75.0%), Postavy (from 9 to 18, +100%), Chashniki (from 29 to 41, +41.4%), Shumilino (from 14 to 27, +92.9%) districts. The amount of claimed demands has increased in Orsha District – from 76 to 117 billion rubles (and is the largest in the region), Novopolotsk – from 1.4 to 17.9 billion rubles, Glubokoye District – from 3.7 to 17.2 billion rubles, Chashniki District – from 6.2 to 11.1 billion rubles.

Claims and applications in foreign currency were filed in 2015 by prosecutors of the city of Vitebsk (13 for 15,205,220 rubles of the Russian Federation), Orsha (4 for 2,283,944 rubles of the Russian Federation, 141,743 euros), Polotsk (4 for 3,927,987 rubles of the Russian Federation), Postavy (4 for 131,657 US dollars, 4,207 euros, 310,769 rubles of the Russian Federation), Rossony (3 for 15,050 euros), Chashniki (1 for 455,758 rubles of the Russian Federation) districts.

It should be noted that in 2015, economic courts considered 538 claims (applications) by prosecutors for a total amount of 199,877,035 thousand rubles, 126,464 US dollars, 1,476,060 euros, 86,979,805 rubles of the Russian Federation.

Federation. 24 cases were terminated (18 in claim proceedings, 5 in order proceedings, 1 of another category). Claims were dismissed in 19 cases (2 in claim proceedings, 16 in order proceedings, 1 of another category). 519 claims (applications) were satisfied for a total amount of 197,271,092 thousand rubles, 126,464 US dollars, 1,319,267 euros, 81,946,138 rubles of the Russian Federation. The voluntarily reimbursed amount for prosecutor's claims was 7,050,113 thousand rubles, 1,186 rubles of the Russian Federation; actually recovered – 60,548,781 thousand rubles, 126,464 US dollars, 243,744 euros, 574,602 rubles of the Russian Federation.

The activities to protect the economic interests of the region's business entities by the regional prosecutor's offices will be continued in the future.
