The Vitebsk Regional Prosecutor's Office discussed current issues of organizing supervision over the legality of court decisions in civil cases, as well as compliance with legislation by enforcement bodies

A training and methodological seminar on the topic: "Current issues of organizing supervision over the legality of court decisions in civil cases, as well as compliance with legislation by enforcement bodies" was held at the Vitebsk Regional Prosecutor's Office.

The event was attended by the First Deputy Prosecutor of the region Korzhov I.N., Deputy Chairman of the Vitebsk Regional Court Fedyukevich A.I., Head of the Department for Supervision over the Legality of Court Decisions in Civil Cases Titkova I.N., Deputy Head of the Department Sashcheko A.G., Senior Prosecutor of the said Department Dukhnova M.V., Prosecutor of the Department Tavtyn I.A., as well as deputies and assistants of prosecutors of cities and districts of the Vitebsk region engaged in civil and judicial supervision.

The seminar was opened by the First Deputy Prosecutor of the region Korzhov I.N., who noted the significance, complexity, and multifaceted nature of supervision over the legality of court decisions in civil cases and defined the main tasks of carrying out this area of prosecutorial activity.

The Head of the Department, Titkova I.N., informed the attendees of the indicators for civil and judicial supervision as of November 25, 2018, as well as the requirements for organizing work on supervision over the legality of court decisions in civil cases under appellate proceedings.

The Deputy Chairman of the Vitebsk Regional Court, Fedyukevich A.I., noted that the institution of appellate proceedings is designed to create additional guarantees for the issuance of a lawful and well-founded court decision. In this regard, the requirements for the quality of preparation of lawsuits and appellate protests by prosecutors are increasing. The Deputy Chairman of the court drew the attention of those present to the specifics of considering civil cases in the appellate instance.

The Deputy Head of the Department, Sashcheko A.G., highlighted the specifics of considering civil cases on claims for the release of property from arrest, the application of CPC norms when considering issues related to property confiscation, and the transfer of property and income received to the state revenue.

Senior Prosecutor of the Department Dukhnova M.V. presented an analysis of judicial and prosecutorial practice in cases concerning complaints about the actions (inaction) of officials and other legal entities that infringe upon the rights of citizens.

Assistant Prosecutor of Gorodok District Matlokh N.A., using examples of judicial practice, highlighted the grounds for the debtor's liability for breach of obligations.

Senior Assistant Prosecutor of Vitebsk City Dedyuro A.P. reported on the changes in the norms of the Civil Code of the Republic of Belarus, the Civil Code, and the Civil Procedure Code, introduced by the Law of the Republic of Belarus of July 17, 2018.

Head of the Department for Supervision of Compliance with Legislation by Criminal Enforcement and Compulsory Enforcement Bodies Pashkovsky V.I. informed about the characteristic violations of legislation in the activities of compulsory enforcement bodies and the prosecutorial response measures to be applied.

In order to improve professional activities, practical sessions were held with the seminar participants on problem-solving, during which problematic issues arising in the consideration of civil cases, and the legality and validity of court decisions were discussed. Seminar participants exchanged work experience in carrying out prosecutorial supervision in this area.

In the final part of the seminar, the Head of the Department Titkova I.N. pointed out the need to improve activities aimed at increasing the quality of case review within appeal periods and preparing well-reasoned and substantiated appeals.
