A training and methodological seminar on civil and judicial supervision was held at the Vitebsk Regional Prosecutor's Office
The seminar was opened by the Deputy Regional Prosecutor, Georgy Korenko, who noted the significance, complexity, and multifaceted nature of supervision over compliance with the law in civil court decisions and defined the main tasks of carrying out this area of prosecutorial activity.
The Head of Department, Irina Titkova, informed the seminar participants about the results of the work in the sector. She noted a positive trend in appealing court decisions in civil cases of mandatory categories. She drew attention to the need to enhance the role of prosecutor's offices in protecting the legitimate rights and interests of the state, legal entities of state ownership, as well as citizens belonging to socially vulnerable groups of the population, by filing lawsuits in courts to invalidate transactions, as well as to restrict the legal capacity of citizens who not only abuse alcoholic beverages but also suffer from mental disorders.
The Deputy Head of Department, Alla Sashcheko, spoke on the practice of applying the Decree of the President of the Republic of Belarus "On the alienation of residential houses in rural areas and the improvement of work with vacant houses."
The Senior Prosecutor of the same department, Maria Dukhnova, based on a conducted generalization, highlighted the judicial and prosecutorial practice in civil cases concerning compensation for damage caused to the state by a crime, and the recovery of income obtained by criminal means.
The Prosecutor of the department, Irina Tavtyn, spoke about the practice of courts considering civil cases on recognizing citizens as having limited legal capacity and legally incompetent. She drew attention to the need
submission of applications for the recognition of citizens as having limited legal capacity, whose ability to understand the meaning of their actions or to control them is limited due to mental disorder (illness).
Assistant Prosecutor of Rossony District Sergey Olesko highlighted the specifics of courts considering civil cases on the release of property from arrest (exclusion from inventory).
In order to improve professional activities, practical exercises were conducted with the seminar participants to solve problems, during which problematic issues arising in the consideration of civil cases, checking the legality and validity of court decisions were discussed.
In the final part of the seminar, the head of the department, Irina Titkova, pointed out the need to improve the quality of case review within appeal periods and to improve claim work.
