Vitebsk Transport Prosecutor's Office: Protection of the Economic Interests of Organizations.

In case of violation of rights and legitimate interests by counterparties, legal entities and individual entrepreneurs file lawsuits in economic courts independently or apply to the prosecutor's office in order to minimize expenses for payment of state duty.

In the past period of 2024, the Vitebsk Transport Prosecutor's Office considered 14 appeals from legal entities regarding the filing of lawsuits by the prosecutor in the economic court, of which 11 were fully satisfied, and 1 was partially satisfied.

For reference. In accordance with paragraph 7 of paragraph 4 of Article 27 of the Law "On the Prosecutor's Office of the Republic of Belarus", upon detection of violations of legislation, depending on their nature, the prosecutor, within the scope of his competence, applies to the court with applications (lawsuits) in defense of the rights and legitimate interests of citizens, including individual entrepreneurs, and organizations, public and state interests, in cases provided for by legislative acts.

Based on the results of the consideration of the above-mentioned appeals, 10 lawsuits (applications) were filed in the economic court in the interests of state-owned enterprises (with a predominant state share) for a total amount of 701,794 rubles, 9 of which were satisfied in the amount of 647,414 rubles, and in one case, a settlement agreement was concluded.

In particular, by the decision of the economic court of the Vitebsk region, debt under a general construction contract in the amount of 76,903 rubles was recovered in favor of OJSC "D.".

In addition, 1 legal entity voluntarily paid off the principal debt in the amount of 20,870 rubles in the pre-trial settlement procedure.
