The Vitebsk transport prosecutor's office conducted an inspection of compliance with legality in the conduct of administrative proceedings by the Vitebsk customs.

The Vitebsk Transport Prosecutor's Office conducted an inspection in March-April 2018 to ensure compliance with the law during administrative proceedings by the Vitebsk Customs and the consideration by the court of the Oktyabrsky District of Vitebsk of cases on administrative offenses provided for by Article 14.1 of the Code of Administrative Offenses of the Republic of Belarus for 2017 and the first 2 months of 2018.

During the inspection, cases of administrative offenses provided for by Article 14.1 of the Code of Administrative Offenses of the Republic of Belarus considered by the court of the Oktyabrsky District of Vitebsk for the specified periods were analyzed, and the legality of bringing persons to administrative responsibility was checked.

Based on the studied cases of administrative offenses, administrative proceedings were conducted for all established facts of illegal movement of goods. As a rule, these were tobacco products. However, there were also cases of moving other goods across the customs border of the EAEU: a vehicle for international transportation (1 case), a moped engine (1 case), 4 car tires (1 case), ferrous metal scrap (1 case), and auto parts (1 case).

When transporting tobacco products, the actions of the offenders were also additionally qualified under Part 1 of Article 12.27 of the Code of Administrative Offenses of the Republic of Belarus.

The inspection showed that there were no instances of the court making illegal decisions, bringing innocent persons to responsibility, or terminating cases of administrative offenses or returning them for correction due to the inclusion of unreliable data about the offender's identity in the administrative offense report.
