"Profitable" trip

The Vitebsk transport prosecutor's office supported the state prosecution in a theft case against 33-year-old N.

During the court investigation, it was established that N. was traveling on an interregional train from "Gomel-Polotsk" to the "Orsha-Tsentralnaya" station. Shortly before the train arrived at Orsha station, while moving towards the exit from the carriage, he saw a mobile phone on a table in one of the compartments. The owner of the phone was sleeping carelessly, which our "hero" took advantage of.

Subsequently, at the "Orsha" station, N. sold the stolen "Huawei" for 30 rubles. The amount of property damage caused to K. amounted to 230 rubles 19 kopecks (subsequently, the phone was seized by police officers and returned to the victim). N.'s actions were qualified under Part 1 of Article 205 of the Criminal Code of the Republic of Belarus.

Based on the evidence presented by the prosecution, the court found N. guilty of committing the specified crime and sentenced him to 1 year of imprisonment. Article 78 of the Criminal Code was applied to N.; the sentence will not be applied if, within a one-year probation period, N. does not commit a new crime and fulfills the duties imposed on him by the court, including paying a criminal legal compensation of 30 base units to the state revenue.

The sentence has entered into legal force.

For reference: In 2019, the Vitebsk Department of Internal Affairs of Transport registered 15 thefts, of which 5 were committed on trains. For the elapsed period of 2020, 3 thefts were registered (0 on trains).
