For the use of undeclared goods in its operations, the enterprise was fined 27 million rubles with the confiscation of vehicles worth over 2 billion rubles.
By the decision of the court of the Oktyabrsky district of Vitebsk, a private transport enterprise of the Beshenkovichi district was brought to administrative responsibility under Part 1 of Article 14.5 of the Code of Administrative Offenses for failing to declare semitrailers acquired from a Latvian firm under lease agreements with the right of subsequent redemption, which were repeatedly imported into the customs territory of the Customs Union from 2013 to 2015 during the transportation of goods as international transport vehicles without paying customs duties, in violation of the requirements of Part 1 of Article 342 of the Customs Code of the Customs Union. As a result, the enterprise failed to pay customs duties in the amount of over 648 million rubles. By the court's decision, the violator was fined 150 base units in the amount of 27 million rubles, and 6 semitrailers worth over 2 billion rubles were confiscated.
The sanction of Part 1 of Article 14.5 of the Code of Administrative Offenses (Undeclaration or inaccurate declaration of goods) entails a fine for a legal entity in the amount of 20 to 500 base units with the confiscation of undeclared goods subject to customs declaration, regardless of ownership, or without confiscation.
Based on the results of the consideration of the enterprise's complaint, the prosecutor's office of the Vitebsk region issued a decision
the court's decision on the confiscation of undeclared vehicles, considering their repeated use over a long period, has been recognized as justified.
