For violation of the entry ban into the Republic of Belarus – criminal liability

In accordance with Article 3712 of the Criminal Code of the Republic of Belarus, the stay in the Republic of Belarus by a foreign citizen or a stateless person, deported or expelled from the Republic of Belarus, until the expiry of the period of prohibition of entry into the Republic of Belarus, in the absence of signs of a crime provided for by Part 2 of Article 371 of this Code, is punishable by arrest or deprivation of liberty for a term of up to three years.

On 30.01.2019, citizen of the Russian Federation P., previously convicted, including under Article 3712 of the Criminal Code of the Republic of Belarus, having been previously forcibly deported from the Republic of Belarus to the territory of the Russian Federation, before the expiry of the period of prohibition of entry into the territory of the Republic of Belarus, arrived in Orsha at the railway station from Smolensk. In connection with the committed crime provided for by Article 3712 of the Criminal Code of the Republic of Belarus, citizen P. was brought to criminal responsibility by the court of Orsha district and the city of Orsha in the form of deprivation of liberty for a term of 1 year and 6 months with serving the sentence in a penal colony under strict regime conditions.

On 12.12.2018, citizen of the Russian Federation G., previously convicted under Article 3712 of the Criminal Code of the Republic of Belarus and forcibly expelled from the Republic of Belarus, before the expiry of the period of prohibition of entry into the Republic of Belarus, arrived by railway transport at the Orsha-Tsentralnaya station, where he was detained by employees of the Orsha transport police. By the sentence of the court of Orsha district and the city of Orsha, G. was found guilty under Article 3712 of the Criminal Code of the Republic of Belarus and was sentenced to 1 year and 3 months of deprivation of liberty with serving the sentence in a penal colony under general regime conditions.
