Procurements conducted in violation of the law have been canceled at the request of prosecutors

Prosecutor's offices of the Vitebsk region, based on the results of monitoring information posted in the public domain on electronic trading platforms conducted this year, have identified violations of legislation committed by customers (organizers) when carrying out procurement of goods (works, services) both at the expense of budget funds and at the expense of their own funds.

Most often, customers made mistakes in choosing the type of procurement procedure, and also improperly formed procurement documentation, which served as the basis for prosecutors to issue supervisory acts with demands to cancel procurement procedures conducted in violation of the law.

For example, the prosecutor of the Gluboksky district established that during public procurement in construction for the selection of organizations for design and survey work on educational institutions, one of the district's enterprises did not take into account the key requirements of the legislation regarding the inclusion in the draft contract, as well as in the procurement documentation, of a mandatory condition for the supplier (contractor, performer) to provide security for the fulfillment of obligations under the contract. At the prosecutor's request, these procurements totaling 63 thousand rubles were canceled.

The prosecutor of Vitebsk city identified violations of legislation on procurement from own funds in the sphere of auditing services procurement.

For reference: According to the Resolution of the Council of Ministers of the Republic of Belarus dated 28.12.2019 No. 936 "On issues of procurement of goods (works, services), attestation and confirmation of auditors' qualifications", procurement of auditing services for mandatory audit of annual accounting and (or) financial statements is carried out by organizations at their own expense using competitions, regardless of the cost of such services.

However, a number of enterprises, in violation of these requirements, procured auditing services through the procedure of requesting price proposals, in connection with which the prosecutor, in his orders, raised the issue of declaring such procurements as failed. The prosecutor's requirements set out in the orders have been fulfilled.

In total, since the beginning of 2022, based on the requirements

7 procurement procedures were cancelled by Vitebsk region prosecutors, and the expenditure of funds in violation of the law in the amount of 93 thousand rubles was prevented, including budget funds in the amount of 74 thousand rubles.
